Terms of service
Draft, last updated 17 October 2026. To be reviewed before the first paid subscription.
1. Provider and scope
First Audit Radar is provided by Christoph Ploner, Eisenstadt, Austria (see Imprint). The service is offered exclusively to businesses; consumers may not subscribe.
2. The service
We provide lists and reports derived from public Form 5500 filings of the U.S. Department of Labor, including a forecast of plans expected to require an independent audit. The service is an information service. It is not legal, tax, accounting or audit advice and does not create any professional relationship with plan sponsors.
3. Accuracy
Forecasts are estimates based on filed data, which may be incomplete, late or incorrect. We describe our method and back-tested hit rate but do not guarantee that any plan will require or engage an auditor.
4. Permitted use
You may use the data for your own business development. You may not resell, publish or redistribute the lists. When contacting plan sponsors you are responsible for complying with applicable law, including the CAN-SPAM Act, the Telephone Consumer Protection Act and professional rules (e.g. AICPA Code of Professional Conduct on advertising and solicitation).
5. Subscription, payment and renewal
Subscriptions run for 12 months from the start date. Prices are shown on the website; payments are processed by our payment provider acting as merchant of record, which may add applicable taxes. You can switch off automatic renewal at any time before the renewal date.
6. Liability
We are liable without limitation for intent and gross negligence. For slight negligence our liability is excluded to the extent permitted by law and in any case limited to the fees paid in the 12 months before the claim.
7. Law and venue
Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction is Eisenstadt, Austria.
